This Privacy Policy (“Policy”) explains how Peppercorn Recruitment Pty Ltd (“Peppercorn”) protects the privacy of your personal information. By providing personal information to Peppercorn (or allowing another person to do so on your behalf), you agree to Peppercorn handling your personal information as detailed in this Policy.

If you do not provide personal information required by Peppercorn, it may not be possible for Peppercorn to provide you with the services you have requested. What is personal information?

Personal information is information which relates to a living individual who can be identified from that information, or from that information and other information in a person’s possession, including any expression of opinion, whether true or not, and whether recorded in material form or not, about an identified or reasonably identifiable individual, and any indication of intention in respect of an individual.

Some personal information is also categorised as “sensitive information” (as defined under Australian privacy laws). Sensitive information includes racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices, and criminal records.

What personal information does Peppercorn collect?

Generally, the type of personal information which Peppercorn may collect about you is information needed to ascertain, and search for, employment opportunities appropriate to you, involve you in any recruitment process(es) you have agreed to participate in, and facilitate employment arrangements on your behalf. For example, Peppercorn may collect details such as your name, contact details, employment history and performance, education and qualifications, work experience, salary and benefits, professional connections and relationships, information and opinions from referees, and details of your involvement in any workplace incidents, as well as your desires and expectations relating to future employment opportunities including relating to career development, salary and benefits.

Some personal information Peppercorn collects may also be categorised as sensitive information under Australian privacy laws. Peppercorn will only collect sensitive information about you with your consent and where reasonably necessary for, or directly related to, one or more of our functions or activities. For example, some recruitment processes may require a criminal history check to be provided as part of a candidate’s application.

How does Peppercorn collect personal information?

In most cases, Peppercorn will collect your personal information directly from you. Peppercorn may collect personal information from you in person, by telephone, letter, email, fax, through the Peppercorn website or through a third party website such as Seek.com.au.

In some cases, it may be necessary for Peppercorn to collect personal information about you from a third party. For example, Peppercorn may contact referees provided by you and other third parties, such as education institutions, professional associations and your current/former employer(s), for verification and vetting purposes. Peppercorn may also receive personal information about you from organisations who have performed background checks (e.g. criminal history checks) or testing in relation to a recruitment process. Where practical, Peppercorn will seek your consent before obtaining personal information about you from a third party.

How does Peppercorn use personal information?

By providing Peppercorn, or otherwise permitting Peppercorn to collect, your personal information, you consent to Peppercorn using your personal information for the purpose(s) for which it was collected, secondary purpose(s) related or ancillary to the primary purpose(s) of collection (in the case of sensitive information, such secondary purpose(s) will be directly related to the primary purpose(s) of collection) and for any other purposes permitted or required by law.

For example, where you contact Peppercorn in relation to seeking, or applying for, an employment opportunity/ies, the primary purpose for which Peppercorn collects your personal information is generally to assess your suitability for a role(s), include you as a candidate in the recruitment process for such role(s) and, where you are the successful candidate, facilitate your transition to your new employer.

Related and ancillary purposes for which Peppercorn may use your personal information include servicing Peppercorn’s relationship with you by, among other things, providing you with updates on employment opportunities, services, events and information (e.g. salary surveys) Peppercorn thinks may interest you; gauging customer satisfaction and seeking feedback regarding Peppercorn’s services; developing, improving and marketing products and services of Peppercorn and/or affiliated businesses; marketing activities including mail-outs, emails, e-newsletters, SMS notifications and telephone calls; Peppercorn’s internal accounting and administration; and other purposes as permitted or required by law (e.g. to prevent a threat to life, health or safety).

Will Peppercorn disclose your personal information to third parties?

By providing Peppercorn, or otherwise permitting Peppercorn to collect, your personal information, you consent to Peppercorn disclosing your personal information to third parties in connection with the purpose for which it was collected or a related or ancillary purpose.

The third parties to whom Peppercorn may disclose your personal information (after consulting with you) include, without limitation, potential/prospective employers, your current/former employer(s), your referee(s), educational institutions and professional associations. Peppercorn may also disclose your personal information to its professional advisors, affiliated businesses, contractors and suppliers (e.g. third party suppliers of IT based solutions that assist Peppercorn to provide products and services to you, including any external data hosting provider Peppercorn may use).

Peppercorn may also disclose your personal information to third parties as permitted or required by law including, without limitation, to comply with our legal obligations, any applicable immigration requirements relating to your employment, requests from qualified government departments or law enforcement authorities (if Peppercorn is satisfied that they have authority to make such request) or where Peppercorn suspects unlawful activity or fraud.

Does Peppercorn send personal information overseas?

Peppercorn will only disclose your personal information to overseas recipients (i.e. recipients outside Australia) when directed by you or otherwise with your consent. This may include where you ask Peppercorn to include you in a recruitment process for an employment opportunity overseas or where you provide details for a referee located overseas.

How secure is your personal information?

Peppercorn respects your privacy and will hold your personal information as securely as it does its own confidential information. Peppercorn has implemented various physical, electronic and managerial security procedures in order to protect your personal information from loss and misuse, and from unauthorised access, modification, disclosure and interference.

Peppercorn will only store your personal information for as long as necessary having regard to the purpose for which it was collected or a related or ancillary purpose. By providing your personal information to Peppercorn, you acknowledge and agree that, if you are unsuccessful for a particular role for which you have applied, Peppercorn may retain your personal information so that you may be considered for future employment opportunities which may be of interest to you (however, Peppercorn will not present you as a candidate for any future opportunities unless you have given consent). Peppercorn may delete your personal information after a reasonable period of time and, if you have not used Peppercorn’s services for some time, you need to re-supply your personal information to us.

Peppercorn’s website may contain links to third party websites over which Peppercorn has no control and for which Peppercorn is not responsible. Peppercorn encourages you to read the privacy policies of any linked websites you visit as their privacy policies and practices may differ to those of Peppercorn.

How can you access and correct your personal information?

Subject to any exceptions set out in applicable privacy laws, Peppercorn will allow you access to any personal information Peppercorn holds about you (note that Peppercorn may require you to prove your identity before permitting access). You may also ask Peppercorn to correct your personal information where you believe it is not accurate, complete, up-to-date or relevant. Peppercorn will respond to any such request within a reasonable time.

If Peppercorn denies access or correction, Peppercorn will provide you with reasons for such denial within a reasonable time. By providing Peppercorn with personal information, you agree, warrant and represent that such personal information is complete, true and accurate at the time you provide it and not intended, or likely, to mislead or deceive Peppercorn or any potential/prospective employer(s). Where you are continuing to receive services from Peppercorn, you agree to update your personal information whenever necessary. You also agree that, in the absence of any update, Peppercorn may assume that the personal information submitted to Peppercorn remains complete and accurate.

Peppercorn also invites you to contact us with any feedback or questions you may have regarding the handling of your personal information by Peppercorn. Peppercorn will endeavour to respond to all requests and questions received within a reasonable time.
